California (FASHLIFE) — Lululemon is suing Costco for selling and knocking off their designs, a new lawsuit filed in California has revealed.
The lawsuit alleged trade dress and patent infringement, as well as unfair competition and violation of the California Unfair Business Practices Act.
Lululemon is asking Costco to pay up, not only for their lost profits but also for harming their brand reputation.
But it won’t be that easy, since fashion law in the United States makes it very hard to win cases against dupes.
Especially when it comes to public opinion, when one item is almost 80-90% less than the other.
The items Lululemon is accusing Costco of copying are now off the website as the lawsuits between the two companies begin.
